Lawyers specializing in debt relief for individuals and the self-employed
At our firm, we understand that financial pressure can be overwhelming. When debts exceed your ability to pay and you feel like you’ve hit a dead end, the Second Chance Law (SCL) is the legal tool designed to offer you a fresh start.
We are not just document managers: we are strategic partners who guide you through a complex legal process to guarantee the Exoneration of Unsatisfied Liabilities
We anticipate risks, assess your financial situation in good faith, and create the most efficient legal strategy so that you, as an individual or self-employed worker, can legally settle your debts and return to economic activity with financial stability.
In an economic environment where unforeseen events can cripple any business, having the support of a specialized legal team is crucial. We focus on providing you with the shortest and safest path to financial freedom, protecting your assets and your future.
What is the LSO and who can benefit from it?
The Second Chance Law is a legal mechanism that allows individuals and self-employed workers facing insolvency to cancel all or a significant portion of their debts.
To qualify, the Law primarily establishes the following requirements (based on the user’s main search intent):
- To be an individual: Be in a situation of current or imminent insolvency (unable to pay debts with your income or assets).
- To act in good faith: Not have been convicted of socioeconomic crimes, crimes against property, or crimes against the Tax Office and Social Security in the previous 10 years.
- To pass the insolvency test: Have debts with at least two different creditors.
- Limit on public debts: You can cancel up to €10,000 with the Tax Office (Hacienda) and another €10,000 with Seguridad Social, including amounts not discharged in a subsequent payment plan.
Our Services under the Second Chance Law
Our consultancy combines insolvency expertise, strategic vision, and a personal, approachable manner, supporting you through every stage of the process.
Our services include, among others:
Feasibility Study and Initial Strategy
We analyze your financial situation, your debts (personal, bank, credit card, utility bills, etc.) and verify that you meet all the requirements of the LSO. We determine whether the most beneficial option is asset liquidation (full debt relief in exchange for liquidating non-exempt assets) or a payment plan (partial debt relief while retaining assets, such as your primary residence).
Comprehensive Management of the Insolvency Process
Exoneration of Unsatisfied Liabilities (EPI its acronym in Spanish)
This is the ultimate goal. Once the process is complete, we will legally request the EPI, which is the resolution that definitively and immediately cancels all unpayable debts. This includes removing your name from credit reporting agencies (ASNEF, RAI), allowing you to resume your credit and financial life.
Protection of your primary residence
We advise you on how to maximize the chances of keeping your main residence (if there is a mortgage) through the payment plan or through the latest reforms of the Insolvency Law, ensuring that the LSO provides you with a real new opportunity.
Can I cancel debts with Hacienda, the Tax Office, and Seguridad Social?
Yes. The law, after recent reforms, allows for the discharge of public debts, although with limits: a maximum of €10,000 of debt to the Tax Agency and a maximum of €10,000 to the General Treasury of the Social Security can be cancelled.
For amounts exceeding this limit, we can propose a payment plan to the judge so that the remaining balance can be paid in a convenient amount of time and without interest.
